The basics.

These terms govern your use of the Nightpenny iOS app and the related website at nightpenny.app. By installing or using either, you agree to them.

Who we are

Nightpenny is a product of Fox Taming, a solo studio. Support: hello@foxtaming.com.

License

We grant you a personal, non-commercial, revocable license to use Nightpenny on iOS devices you own or control, subject to Apple's End User License Agreement (which applies to every iOS app) and these terms.

Subscriptions

Monthly and yearly plans auto-renew. Payment is charged to your Apple ID at confirmation of purchase. Your subscription auto-renews unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period, at the price displayed on the paywall at the time of purchase.

Subscriptions can be managed, and auto-renewal turned off, in your Apple ID account settings after purchase: Settings → [your name] → Subscriptions.

The lifetime plan is a one-time purchase. No recurring charge, no auto-renew. It unlocks the full app for the life of the Apple ID that purchased it.

Free trials

If a free trial is offered on the paywall, Apple will not charge you until the trial ends. Cancel at any time before that to avoid any charge. Trials are limited to one per Apple ID, across plan types.

Pricing & offers

Prices are shown in your local currency on the paywall. We may change prices, offer promotions, or retire promotional plans at any time. The lifetime plan is a launch-window offer and may be removed without notice; existing lifetime customers keep lifetime access regardless.

Refunds

Refunds for Apple-processed purchases are handled by Apple, not by Fox Taming. Request a refund at reportaproblem.apple.com. We're happy to help you navigate that process — email hello@foxtaming.com.

Not a medical device

Nightpenny is not a medical device. It does not diagnose, treat, prevent, or cure any medical condition. It displays patterns from your own historical sleep data; it does not predict sleep outcomes. The methodology page explains the reasoning behind every visible number.

If you experience persistent sleep concerns, daytime dysfunction, or symptoms that worry you, consult a qualified healthcare provider. The app is a reflection tool, not a treatment.

Your content

You retain all rights to your data. We don't upload it, sell it, or share it. See the privacy page for detail on what stays on device (almost everything) and what doesn't (event names only, and only if you opt in).

Acceptable use

You agree not to:

• Reverse-engineer the app beyond what applicable law permits.
• Use the app in a way that harms Fox Taming, Apple, or other users.
• Misrepresent the app's outputs as medical advice.

Warranties & disclaimers

The app is provided as is. To the maximum extent permitted by law, we disclaim all warranties — express, implied, statutory — including merchantability, fitness for a particular purpose, and non-infringement. Nothing in these terms limits rights you have under mandatory consumer-protection law.

Limitation of liability

To the maximum extent permitted by law, Fox Taming's total liability arising out of or related to the app is limited to the amount you paid to us (directly or via Apple) in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

Changes to these terms

We may update these terms. Material changes trigger an in-app notice. Continued use after a change means you accept the update. The Last updated date at the top always reflects the current version.

Governing law

These terms are governed by the laws of France, without regard to conflict-of-laws rules. Courts in Fox Taming's jurisdiction have exclusive venue, unless mandatory consumer law entitles you to sue where you live.
